Description:
In light of decisions made in Full Court meeting held on 05-12-2023, the Hon'ble Chief
Justice and Judges are pleased to direct the following with immediate effect:
i. The appeals filed during the period 22.02.2020 to 03.05.2023, i.e. prior to the Code of
Civil Procedure (Amendment) Act, 2023 dated 04-05-2023, will be heard and decided by
the Islamabad High Court as per saving clause provided in Section 159 of the Code of
Civil Procedure (Amendment) Act, 2023.
ii. All pending and fresh bails filed in offences under the Control of Narcotic Substances
Act, 1997, will be fixed before the Single Bench(es).
iii. In pursuance of the amendment in the Lahore High Court Rules and Orders Volume-V
vide this Court's Notification No.152 /Legis./IHC/ 576, dated 26.12.2023 , it is hereby
informed that all pending & fresh appeals will be fixed before the Single Bench(es) with
immediate effect, however, this circular will have no effect on fixation of those appeals
before Division Bench(es) falling under specific provision of statutory law.
